This process automatically generates a completed WA Advance Health Directive in the new updated 2022 prescribed form for a WA Advance Health Directive contained in Schedule 2 of the Guardianship and Administration Regulations 2005 (WA).
The legal requirement to use the new prescribed form commenced on 4 August 2022 (with a 6 month transition period where the previous version of the form is still valid).
Your completed WA Advance Health Directive covers up to three Medical Treatment Decisions which will apply at any time you are unable to make reasonable judgments in respect of the specified Medical Treatments.
1️⃣ A Medical Treatment is defined as any medical, surgical or dental treatment or other health care;
2️⃣ A Medical Treatment Decision is defined as a decision to consent or refuse consent to the commencement or continuation of any Medical Treatment;
3️⃣ A Medical Treatment Decision only operates in the circumstances that you specify;
4️⃣ A Medical Treatment to which you consent can be provided to you; and
5️⃣ A Medical Treatment to which you refuse cannot be provided to you.
You can also detail:
➲ Whether or not you have appointed an Enduring Guardian;
➲ What things are most important to you or might worry you about your future health; and
➲ Your preferences for participating in medical research.
Important: It is strongly recommended that you discuss your Medical Treatment Decisions with your doctor, surgeon or dentist before you complete this WA Advance Health Directive.
Note: Your Enduring Guardian cannot override decisions made in your WA Advance Health Directive, except in special circumstances (e.g. new treatments options have become available that did not exist when you completed your WA Advance Health Directive).
To revoke your prior WA Advance Health Directive, you must have full legal decision making capacity.
Western Australia legislation provides safeguards to ensure that WA Advance Health Directives cannot be made, amended or revoked if you do not have full legal decision making capacity.
There is a statement within the WA Advance Health Directive that allows you to indicate you are revoking any previous versions.
The WA Department of Health recommends you give written notification of the revocation to all relevant persons and organisations, including GPs, healthcare providers and family members and those who currently hold a copy of the old outdated WA Advance Health Directive you are revising.
Everyone who holds an old revoked copy should return it to you to be destroyed.
