This automated process uses the Advance Personal Plan form prescribed by the government of the Northern Territory.
The Advance Personal Plan replaces enduring powers of attorney in the Northern Territory.
The Advance Personal Plan has a section that can be used to appoint decision makers for personal and financial matters.
It can also be used to make an advance care statement as well as legally binding advance consent decisions about medical treatment.
Document Overview:
1️⃣ The plan maker can specify conditions and limitations on the donees’ authority;
2️⃣ The plan maker can sign personally or direct another person to sign for them;
3️⃣ Details for prescribed witness can be inserted in the form if known;
4️⃣ The donee does not need to sign for the appointment to be effective.
If you are a member of a Self-Managed Super Fund (SMSF) and proceed to and lose your legal decision making capacity you will encounter expensive and complex legal issues if you don't have an Advance Personal Plan already in place.
The Superannuation Industry (Supervision) Act 1993 (Cth) (SISA) allows a Decision Maker under an Advance Personal Plan to act on behalf of a member.
